1. Acceptance of Terms of Service
By downloading or using the App, these Terms of Service (“Terms”) will be a binding legal agreement between you as a user (“you”) and Fika Holdings Pte. Ltd. (“Fika”, “we”, “us”). Therefore, you should make sure, that you read the Terms carefully before using the Fika app (“App”). You’re not allowed to copy or modify the App, any part of the App, or our trademarks in any way. You’re not allowed to attempt to extract the App’s source code, and you also shouldn’t try to translate the App into other languages or make derivative versions. The App itself and all the trademarks, copyright, database rights, and other intellectual property rights related to it belong to us.
Fika is committed to ensuring that the App is as useful and efficient as possible. For that reason, we reserve the right to make changes to the App or charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.
Please be aware that if you subscribe to our services in-app, the Terms of your subscription will be automatically renewed for additional periods of the same duration of the initial term at Fika’s then-current fee for that service. You always have the right to cancel your subscription in accordance to Section 3 below.
2. Fika Rules
Before you can use the App, you need to register for an account (“Account”). To be able to create an account you must:
- 1. be at least 18 years old, or be old enough to enter into a contract under the laws of your home country
- 2. be legally allowed to use the App by the laws of your home country.
By using the App you acknowledge that we store and process the personal data you have provided to us to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We, therefore, recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features, and it could mean that the App won’t work properly or at all. The app does use third-party services that declare their own Terms and Conditions.
If you feel like you for some reason need to leave or take a pause from Fika, you can delete your Account at any time by going into your account settings. If you choose to delete your Account, the data will be removed immediately and cannot in this moment be restored. If you re-create your account with the same credentials, a new account will be opened.
We use a combination of automated systems and manual operators to actively review accounts, contents and messages identifying content that may violate our Terms of Service. We retain the unilateral right to terminate or suspend any account, limit access to the application, or employ various operational, technological, legal, or other measures to uphold the Terms. This includes the option to block specific IP addresses, all without prior notice and without incurring any liability.
Without limiting the foregoing, we explicitly reserve the right to terminate or suspend your account without notice under the following circumstances: (1) violation of these terms, (2) inappropriate conduct on the application, including interactions with other users (both on and offline), at our sole discretion, (3) determination by us or our affiliates that your conduct on other apps operated by our affiliates was inappropriate, or (4) any other reasons deemed justifiable for termination at our sole discretion. If your account is terminated or suspended, you acknowledge and agree that you will not be entitled to a refund for any paid services or features for which you have already been charged.
3. Payment Terms
Generally. Fika provides the option to purchase products and services within the App ("In-App Purchase"). By opting for an In-App Purchase, you recognize and agree that additional terms, presented to you during the purchase process, may be applicable, and these additional terms are considered part of this agreement.
You can make an In-App Purchase through the following Payment Method: (a) completing a purchase via a third-party platform like the Apple App Store and Google Play Store ("Third Party Store"), or (b) making payment with your credit card, debit card, or PayPal account, with processing handled by a third-party processor. Upon making an In-App Purchase, you grant us authorization to charge your selected Payment Method. In the event that payment is not received from your chosen Payment Method, you commit to promptly settle all outstanding amounts upon our request.
Auto-Renewal. Fika may provide certain services in the form of automatically-renewing subscriptions, such as one-week, one-month, or three-month subscriptions ("Premium Services"). IF YOU ACQUIRE AN AUTOMATICALLY RENEWING SUBSCRIPTION, YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW AT THE END OF THE TERM, UNLESS YOU OPT TO CANCEL, AT FIKA’S CURRENT PRICE FOR SUCH SUBSCRIPTIONS. To prevent charges for a new subscription period, it is necessary to cancel, as outlined below, before the conclusion of the ongoing subscription period. Deleting your account or uninstalling the application from your device does not terminate your subscription. Should Fika modify these prices and you do not cancel your subscription, you agree to be charged at Fika’s prevailing subscription pricing.
Cancel Subscriptions. If you obtained a subscription through a Third Party Store, such as the Apple App Store or the Google Play Store, you must access your account with that Third Party Store and follow the provided instructions to modify or terminate your subscription. Upon cancellation, you retain the right to use your subscription until the end of the paid period, but (i) a prorated refund will not be applicable, (ii) your subscription will not renew upon its expiration, and (iii) you will lose access to the Premium Services or In-App Purchases associated with your subscription.
Notably, canceling your subscription doesn't remove your profile from our Services since our platform can be utilized without a subscription. To entirely terminate your account, you must go into your Account settings and delete the account.
Free Trials. If you enroll in a free trial and do not cancel, your trial may transition into a paid subscription, and your Payment Method will be billed at the prevailing rate for such a subscription. Following the conversion of your free trial to a paid subscription, automatic renewal will persist at the conclusion of each period, with your Payment Method being charged, unless you opt to cancel. To avoid charges for a new subscription period, it is essential to cancel before the conclusion of the current subscription or free trial period, as detailed above. Deleting your account or uninstalling the application from your device does not terminate your free trial.
If you have previously signed up for a free trial on Fika through the Apple Store or Google Play Store, you will not qualify for another free trial. Instead, you will be automatically enrolled in a subscription and charged as outlined here.
Virtual Items. You may have the opportunity to acquire or earn a limited, personal and non-transferable virtual items. These items could encompass virtual products, “coins” or other units exchangeable within the App for virtual goods, collectively referred as “Virtual Items”. Fika retains the authority to manage, regulate, control, modify, or eliminate Virtual Items at any time, with no liability to you or any third party in the event of the exercise of such rights. YOU ACKNOWLEDGE THAT FIKA IS NOT OBLIGATED TO PROVIDE A REFUND FOR VIRTUAL ITEMS UNDER ANY CIRCUMSTANCES, AND NO MONEY OR COMPENSATION WILL BE PROVIDED FOR UNUSED VIRTUAL ITEMS UPON ACCOUNT CLOSURE, WHETHER VOLUNTARY OR INVOLUNTARY.
Refunds. In general, charges for purchases are nonrefundable, and there are no refunds or credits for partially used periods.
To initiate a refund request: If you subscribed using your Apple ID, refund processes are managed by Apple, not Fika. To request a refund, navigate to iTunes, click on your Apple ID, select “Purchase history,” locate the transaction, and click “Report Problem.” Alternatively, you can submit a request at https://getsupport.apple.com.
4. Push Notifications and Email Marketing
We may send you emails, push notifications, alerts, and other messages regarding the App and/or Fika services, covering updates, offers, products, events, and promotions. Upon installing the App, you will be prompted to accept or decline push notifications/alerts. If you decline, no push notifications/alerts will be received. If you accept, these notifications will be sent automatically. If you wish to stop receiving push notifications/alerts from the App, you can opt out by adjusting your notification settings on your mobile device. For other forms of communication, such as emails and text messages, you can unsubscribe or opt out by either following the instructions provided in those communications or by sending an email to us at firstname.lastname@example.org.
5. Limitations of Liability
You should be aware that there are certain things that Fika Holdings Pte Ltd will not take responsibility for. Certain app functions will require the app to have an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but Fika Holdings Pte Ltd cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi and you don’t have any of your data allowance left.
If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app or other third-party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside your home territory (i.e., region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.
Along the same lines, Fika Holdings Pte Ltd cannot always take responsibility for the way you use the app, i.e., you need to make sure that your device stays charged — if it runs out of battery and you can’t turn it on to avail the Service, Fika Holdings Pte Ltd cannot accept responsibility.
Concerning Fika Holdings Pte Ltd’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. Fika Holdings Pte Ltd accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.
At some point, we may wish to update the app. The app is currently available on Android & iOS — the requirements for both systems (and any additional systems we decide to extend the app's availability to) may change, and you’ll need to download the updates if you want to keep using the app.
Fika Holdings Pte Ltd does not promise that it will always update the app so that it is relevant to you and/or works with the Android & iOS versions that you have installed on your device. However, you promise to always accept updates to the application when offered to you. We may also wish to stop providing the app and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.
As Fika grows, adjustments to these Terms may become necessary, and thus, we retain the right to modify, amend, or change the Terms at our discretion (referred to as a "Change"). In such cases, the Changes will be publicly posted on this page, and we will specify the Effective Date of the updates at the bottom of the Terms. Under certain circumstances, we may also send you an email notifying you of a Change. There is a possibility that we may request your agreement to the Changes, and we will communicate this clearly.
It is important to regularly check this page for any notifications of Changes, as we aim to keep our users well-informed.
Your continued use of Fika after any Change implies your acceptance of the Change, and you will be legally bound by the updated Terms. If you do not agree with any Changes to the Terms, we recommend that you stop using Fika (though we understand this might be a bit challenging!).
